RU-788-80 CITY EMPLOYEES UNION, LOCAL 237, RU-793-80 I.B.T. -and-THE CITY OF NEW YORK -----------------------------------X DECISION AND ORDER On September 3, 1980, District Council 37, AFSCME, AFL-CIO, filed its petition (RU-788-80) herein, seeking to add the titles of Assistant Archivist, Archivist, and Associate Archivist to Certification No. 46C-75 (as amended), covering various clerical and related titles, including various levels of Department Librarians. On September 30, 1980, City Employees Union, Local 237, I.B.T., filed its petition (RU-793-80) herein, seeking to add the same titles to Certification No. 67-78 (as amended), covering various custodial, maintenance, stock, inspectorial, skilled crafts, and related titles, including Archival Aide (CETA). In a letter dated December 22, 1980, the City's Office of Municipal Labor Relations (hereinafter OMLR) stated that it took no position ". . . at this time . . ." on these petitions.
2. Decision No. 11-81 Docket Nos. RU-788-80 RU-793-80 The Board ordered that these cases be consolidated for the purpose of hearing on the issue of unit placement. At the hearing on March 25, 1981, Local 237 requested to withdraw its petition. The request is hereby granted. In a letter dated May 6, 1981, the OMLR stated that it wished "to amend its position inasmuch as the Petition filed by Local 237 was withdrawn ... The City has no objection to the Petition filed by District Council 37 ....” There is no longer any dispute, and our investigation shows that the petitioned-for titles share a community of interest with the titles in Certification No. 46C-75 (as amended) and that the other requirements for accretion have been met. Accordingly, we shall grant the petition of District Council 37. 0 R D E R NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED that the request by City Employees Union, Local 237, I.B.T., to withdraw its petition herein be, and the same hereby is, granted; and it is further
3. Decision No. 11-81 Docket Nos. RU-788-80 RU-793-80 ORDERED that Certification No. 46C-75 (as previously amended) be, and the same hereby is further amended to include the titles of Assistant Archivist, Archivist and Associate Archivist, subject to existing contracts, if any.
