RE-241-72 RU-561C-76 LOCAL 375, CIVIL SERVICE TECHNICAL GUILD, DISTRICT COUNCIL 37, AFSCME, AFL-CIO -----------------------------------X SUPPLEMENTAL DETERMINATION AND ORDER On August 22, 1978, the Board issued its Determination and Order in this case (Decision No. 45-78), concerning the managerial/confidential status of forty job titles. Since that time, it has come to the Board’s attention that clarification of our Decision as it affects the Project Manager title is necessary. The title of Project Manager is classified both by the New York City Department of Personnel and the New York City Health and Hospitals Corporation (HHC) Our ruling in Decision No. 45-78 finding the title non-managerial was based upon testimony and evidence relating only to Project Managers employed by the HHC (title code number 03971) and was not intended to include Project Managers classified by the Department of Personnel (title code number 22503). The use of both numbers in the Appendix to the Decision was erroneous. There is insufficient evidence in the record for a determination on the managerial/confidential status of the
Decision No. 45A-78 2 Docket Nos. RE-241-72 RU-561C-76 eight Project Managers (title code number 22503) employed in the Office of Economic Development and the Department of Ports and Terminals. Accordingly, we dismiss the petitions of both parties insofar as they relate to the title Project Manager (title code number 22503) without prejudice to the timely filing, by either party of a petition, for determination of the collective bargaining status of this title. 0 R D E R Pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED, that the Appendix to Decision No. 45-78 be amended by the deletion of Project Manager Title Code Number 22503.
