(Official decision follows.) __________________________________________________________________ OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION In the Matter of the Certification Proceeding -between-ORGANIZATION OF STAFF ANALYSTS, Petitioner, -and-NEW YORK CITY HEALTH AND HOSPITALS CORPORATION, Respondent, -and-DISTRICT COUNCIL 37, AFSCME, AFL-CIO, Intervenor. __________________________________________________________________ ORDER AMENDING CERTIFICATION On June 26, 2008, the Organization of Staff Analysts (“OSA”) filed a petition seeking to accrete employees in the title of Manager, Scheduling and Control (EDP) (Title Code No. 03992D) employed at the New York City Health and Hospitals Corporation (“HHC”) into its bargaining unit, Certification No. 3-88, which includes titles such as Systems Project Leader (EDP), Supervising Systems Analyst, Systems Analyst, Assistant Systems Analyst, and Senior Systems Analyst. On August 27, 2008, District Council 37, AFSCME, AFL-CIO (“DC 37”) moved to intervene seeking
2 OCB2d 34 (BOC 2009) 2 to accrete the title into its bargaining unit, Certification No. 46D-75, which includes titles such as Systems Analyst (EDP), Assistant Systems Analyst (EDP), and Senior Systems Analyst (EDP). On September 9, 2009, the parties entered into an Agreement for Consent Election, in which they stipulated that the Manager, Scheduling and Control (EDP) title is appropriately placed in either union’s bargaining unit. The Director of Representation approved the Agreement for Consent Election, which is consistent with the record and with the criteria used by the Board to determine appropriate bargaining units. See § 1-02(k) of Rules of the Office of Collective Bargaining (Rules of the City of New York, Title 61, Chapter 1) (“OCB Rules”). Pursuant to the parties’ Agreement for Consent Election, an election was held in this matter in accordance with OCB Rule § 1-02. The ballots were counted on October 27, 2009. The majority of employees in the title Manager, Scheduling and Control (EDP) casting valid ballots selected the Organization of Staff Analysts as their representative for collective bargaining. No party filed objections in the time provided by OCB Rule § 1-02(r). NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law (New York City Administrative Code, Title 12, Chapter 3), it is hereby ORDERED that Certification No. 3-88 (as previously amended) be, and the same hereby is, further amended to add the title of Manager, Scheduling and Control (EDP) (Title Code No. 03992D), subject to existing contracts, if any.
