R-34-67 -and-DECISION NO. 8-68 NEW YORK CITY FIRE DEPARTMENT ------------------------------- x DECISION AND CERTIFICATION On April 12, 1967, Civil Service Technical Guild, Local 375, A.F.S.C.M.E., AFL-CIO, herein called Petitioner, filed a petition with the New York City Department of Labor, requesting certification as the exclusive bargaining representative of employees in the title "Senior Fire Prevention Inspector" employed in the Fire Department. This proceeding was transferred to the Board of Certification pursuant to Rule 13.13 of the Consolidated Rules of the Office of Collective Bargaining. Upon consideration of the investigation made by the Department of Labor, and of its own investigation, and after due deliberation, the Board of Certification renders the following decision. I. Undisputed Matters The Department of Labor, in 1965, found that Senior Fire Prevention Inspectors employed in the Fire Department constitute a unit appropriate for the purposes of collective bargaining and certified City Employees Union Local 237, I.B.T. as their representative (Case No. R-241-65; Cert. No. 8-49). It is undisputed, and we find and conclude that, in fact and within the meaning of the New York City Collective Bargaining Law: Petitioner is a public employee organization; and the unit appropriate for purposes of collective bargaining consists of the employees in the title "Senior Fire Prevention Inspector" employed in the Fire Department. II. Representative Status City Employees Union, Local 237, I.B.T. has disclaimed interest in the present proceeding. Petitioner has requested and the Office of Labor Relations has agreed, that Petitioners representative status be determined on the basis of unrevoked authorizations for the check-off of dues.
Docket No. R-34-67 -2-Decision No. 8-67 Our investigation discloses that all employees in the appropriate unit have authorized dues check-off deductions in behalf of Petitioner. Accordingly, we find and conclude that Petitioner has been designated and selected by a majority of the employees in the appropriate bargaining unit as their representative for the purposes of collective bargaining. CERTIFICATION By virtue of and pursuant to the authority vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby CERTIFIED, that Civil Service Technical Guild, Local 375, A.F.S.C.M.E., AFL-CIO, is the exclusive representative for the purposes of collective bargaining of all Senior Fire Prevention Inspectors employed in the New York City Fire Department.
