RU-50-68 THE CITY OF NEW YORK --------------------------------- x DECISION AND ORDER Local Union No. 3, I.B.E.W., AFL-CIO, herein called Petitioner, filed an application to transfer to Petitioner two certifications previously issued to Independent Traffic Employees Union as collective bargaining representative of (a) Traffic Device Maintainer and Traffic Device maintenance (9 NYCDL No. 10 and MR 9-67) and (b) Foreman (TDM) and Senior Foreman (TDM) (Certification No. 16-68) employed by the City of New York. On June 15, 1968, notice of the application was published in the City Record. On June 19, 1968, Local 1455, A.F.S.C.M.E., AFL-CIO, requested that the transfer application be held in abeyance because Local 1455 was filing a "raiding" charge against Petitioner with the AFL-CIO. Thereafter, the Board, at the request of the President of the AFL-CIO, as a matter of comity, and with notice to the parties, agreed to hold the matter in abeyance until August 31st. No further extension was requested, nor have we been advised of any decision in that matter. Accordingly, we will proceed to determine Petitioner's application. It appears, from our investigation, that the affiliation of Independent Traffic Employees Union with Petitioner was duly approved at a meeting of the membership of that union. The affiliation has been completed, and a majority of the employees in each certified unit has authorized dues check-off on behalf of Petitioner. Accordingly, the application to transfer the certifications will be granted. O R D E R Pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby
DECISION NO. 77-68 2 DOCKET NO. RU-50-68 O R D E R E D, that the application to transfer to Local Union No. 31, I.B.E.W., AFL-CIO, Certi-ficiations 9 NYCDL No. 10 and MR 9-67 and 16-68, be, and the same hereby is, granted and it is further O R D E R E D, that Certifications 9 NYCDL No. 10 and MR 9-67 and 16-68, be, and the same hereby are, amended by substituting "Local Union No. 3, I.B.E.W., AFL-CIO" for "Independent Traffic Employees Union" in said certifications.
