R-109-67 -and-DECISION NO. 37-68 THE CITY OF NEW YORK ------------------------------ x DECISION, ORDER AND CERTIFICATION Social Service Employees Union filed a petition with the New York City Department of Labor for certification as the collective bargaining representative of the Case Aides and Case Aide Trainees employed in the Department of Social Services. The proceeding was transferred to the Board of Certification pursuant to Rule 13.13 of the Consolidated Rules of the Office of Collective Bargaining. The City contends that Case Aide Trainees are not employees of the City of New York, and evidence on that issue has been submitted at a hearing held before a Trial Examiner. Subsequent to the hearing, the parties executed an agreement for determination of the collective bargaining representative of Case Aides by check-off of dues, and further agreed, subject to the approval of the Board, that the title of Case Aide should become part of the unit of Caseworkers and related titles, for which Petitioner is the certified collective bargaining representative (6 N.Y.C.D.L. 58). Accordingly we shall sever that portion of the proceeding which relates to Case Aide Trainees. Our investigation discloses that a majority of the Case Aides employed by the City of New York have demonstrated their desire to be represented for the purposes of collective bargaining by Petitioner by having authorized check-off of dues in behalf of said organization.
Docket No. R-109-67 2 Decision No. 37-68 ORDER AND CERTIFICATION Pursuant to the power vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED, that so much of this proceeding as relates to the title, Case Aide Trainee, be, and the same hereby is, severed; and it is hereby CERTIFIED, that Social Service Employees Union is the exclusive representative for the purposes of collective bargaining of all Case Aides employed by the City of New York; and it is further ORDERED, that Certification No.6N.Y.C.D.L. 58, be,, and the same hereby is, amended to include the title of Case Aide.
