L.1070, DC37 v. Jud. Confer., 2 OCB 31 (BOC 1968) [Decision No. 31-68 (Cert.)] OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION ----------------------------------------- x In the Matter of LOCAL 1070, D.C.37, A.F.S.C.M.E., AFL-CIO DOCKET NO. R-248-65 -and-DECISION NO. 31-68 THE JUDICIAL CONFERENCE OF THE STATE OF NEW YORK ----------------------------------------- x DECISION AND CERTIFICATION LOCAL 1070, DISTRICT COUNCIL 37, AMERICAN FEDERATION of STATE, COUNTY and MUNICIPAL EMPLOYEES, AFL-CIO, herein called Petitioner, filed its petition herein with the New York City Department of Labor on December 30, 1965. The Labor Department found that the employees in the titles of Law and Equity Clerk, Head Clerk (Law and Equity), and Chief Clerk (Law and Equity), employed in the unified Court System of the City of New York constituted a unit appropriate for the purposes of collective bargaining and, on September 14, 1967, conducted an election among the employees in that unit. A majority of the employees casting valid ballots selected the Petitioner as their representative for the purposes of collective bargaining. No objections to the election were filed. The proceedings thereafter were transferred to the Board of Certification pursuant to Rule 13.13 of the Consolidated Rules of the Office of Collective Bargaining. The unit found appropriate by the Department of Labor consists of a readily identifiable and homogeneous group of employees with common interests employed by the Judicial Conference. Accordingly, we, too, find that they constitute an appropriate bargaining unit. A majority of the employees having voted in favor of representation by the Petitioner, we shall certify it as the representative of the unit.
Docket No. R-248-65 Decision No. 31-68 CERTIFICATION Pursuant to the power vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby, CERTIFIED, that LOCAL 1070, D.C.37, AFSCME, AFL-CIO has been designated and selected by a majority of the employees in the titles of Law and Equity Clerk, Head Clerk (Law and Equity), and Chief Clerk (Law and Equity), employed in the unified Court System of the City of New York as their representative for the purposes of collective bargaining and that it is the exclusive representative of all said employees for such purposes.
