City, 2 OCB 22 (BOC 1968) [Decision No. 22-68 (Cert.)] OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION ---------------------------------------- x In the Matter of CIVIL SERVICE TECHNICAL GUILD, LOCAL 375, D.C.37, AFSCME Docket No. R-40-67 -and-Docket No. R-41-67 CITY OF NEW YORK Decision No. 22-68 ---------------------------------------- x Decision and Certification On April 18, 1967, Civil Service Technical Guild, Local 375, D.C.37, AFSCME, filed two petitions with the New York City Department of Labor for certification as the collective bargaining representative of Junior Physicists, Assistant Physicists (including specialties), Physicists (including specialties), Senior Physicists (including specialties), Assistant Scientists (Radiation Control), Scientists (Radiation Control), and Senior Scientists (Radiation Control), employed in various City Agencies. The proceeding was transferred to the Board of Certification pursuant to Rule 13.13 of the Consolidated Rules of Collective Bargaining. Our investigation disclose s that all of the above titles belong more properly in a single unit. The City and Petitioner now have agreed that the single unit is appropriate for the purposes of collective bargaining and that the representative status of petitioner be determined upon the basis of current dues check off authorizations. Our investigation discloses that a majority of the employees in the appropriate unit have authorized dues check off in behalf of the Petitioner. Accordingly, we find and conclude that Petitioner has been designated and selected by a majority of its employees in the appropriate unit as their representative for the purposes of collective bargaining. CERTIFICATION Pursuant to the authority vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby CERTIFIED that the Civil Service Technical Guild, Local 375, D.C.37, AFSCME is the exclusive representative for the purposes of collective bargaining of all Junior Physicists, Assistant Physicists (including specialties), Physicists (including specialties), Senior Physicists (including specialties), Assistant Scientists (Radiation Control), Scientists (Radiation Control), and Senior Scientists (Radiation Control) employed in the City of New York.
