R-44-67 & R-48-67 -and-DECISION NO. 20-68 LOCAL 371, D.C. 37, A.F.S.C.M.E., AFL-CIO -and-NEW YORK CITY DEPARTMENT OF SOCIAL SERVICES ----------------------------------- x DECISION, CERTIFICATION, AND ORDER Municipal Association of Electronic Data Processing Personnel, herein called the Association, filed its petition herein with the New York City Department of Labor on June 2, 1967. Local 371, D.C. 37, A.F.S.C.M.E., AFL-CIO, herein called Local 371, filed its petition with the Department of Labor on May 8, 1967. The Labor Department found that the Computer Operators and Senior Computer Operators employed in the Department of Social Services constitute a unit appropriate for the purposes of collective bargaining and, on December 1, 1967, conducted an election among the employees in that unit. Both the Association and Local 371 appeared on the ballot. A majority of the employees casting valid ballots selected the Association as their representative for the purposes of collective bargaining. No objections to the election were filed. The proceedings thereafter were transferred to the Board of Certification pursuant to Rule 13.13 of the Consolidated Rules of the Office of Collective Bargaining. The unit found appropriate by the Department of Labor consists of a readily identifiable and homogenous group of employees with common interests. No public employee organization having petitioned for a city-wide unit including these employees, we, too, find that they constitute an appropriate bargaining unit. A majority of the employees having voted in favor of representation by the Association, we shall certify it as the representative of the unit.
