City, 2 OCB 16 (BOC 1968) [Decision No. 16-68 (Cert.)] OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION ----------------------------------- x In the Matter of Independent Traffic Employees Union Docket No. R-57-67 -and-Decision No. 16-68 City of New York ----------------------------------- x Decision and Certification On August 1, 1967, Independent Traffic Employees Union filed a petition with the New York City Department of Labor for certification as the collective bargaining representative of the Senior Foremen (T.D.M.) employed in the Department of Traffic. The proceeding was transferred to the Board of Certification pursuant to Rule 13.13 of the Consolidated Rules of the Office of Collective Bargaining. In 1961, Local 1455, District Council 37, AFSCME, AFL-CIO was certified by the Department of Labor as the collective bargaining representative of the Senior Foremen (T.D.M.). On February 13, 1968, Local 1455 was duly notified of the present proceeding and was advised that unless it intervened therein on or before February 23rd, the Board would assume that Local 1455 was not interested and the Board's investigation would be continued without further notice. Local 1455 has not intervened or appeared herein. Petitioner previously was certified by the Department of Labor as the collective bargaining representative of Foremen (T.D.M.). The City and Petitioner now have stipulated that the unit appropriate for the purposes of collective bargaining consists of Foremen (T.D.M.) and Senior Foremen (T.D.M.), and that the representative status of petitioner be determined upon the basis of current dues check-off authorizations. Our investigation discloses that a majority of the employees in the appropriate unit have authorized dues check-off in behalf of Petitioner. Accordingly, we find and conclude that Petitioner has been designated and selected by a majority of the employees in the appropriate unit as their representative for the purposes of collective bargaining. CERTIFICATION Pursuant to the authority vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby CERTIFIED that Independent Traffic Employees Union is the exclusive representative for the purposes of collective bargaining of all Foremen (T.D.M.) and Senior Foremen (T.D.M.).
