RU-13-68 Judicial Conference of the State of New York -------------------------------------------- x DECISION AND ORDER The petition in this matter, dated January 29, 1968,, and filed with the Office of Collective Bargaining on January 30, 1968, seeks certification of Supreme Court Probation Officers Association as the collective bargaining representative of Probation Officers and Probation Officers (Incumbent) employed in the Departments of Probation in the Supreme Courts for the First, Second, and Eleventh Districts in New York City. There is in force a certificate issued by the New York City Department of Labor (8 NYCDL 100 - issued 6/16/66) in which the Probation and Parole Officers Association of Greater New York was certified as the exclusive representative for the purposes of collective bargaining of all Probation Officers, Probation Officers (Incumbent) and Probation Officer Trainees employed by the Judicial Conference. The certified unit includes all non-supervisory Probation Officer titles then in use in the courts in New York City. The qualifications for the various Probation Officer titles are identical throughout the courts in New York City and the nature of the work performed by these employees in the various courts is substantially similar. We find that it would not effectuate the purposes of the statute to sever the titles requested by petitioner herein and fragment the established unit. Accordingly, we shall dismiss the petition. O R D E R By virtue of and pursuant to the power vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby, ORDERED, that the petition herein be, and the same hereby is, dismissed.
