Each petition seeks certification as the collective bargaining representative of certain employees of the Judicial Conference, specifically Case No. R-107-66: laborers; Case No. R-133-66: clerical and related titles; Case No. R-208-66: motor vehicle operators. The Judicial Conference's election to come under the jurisdiction of the Office of Collective Bargaining is restricted to non-judicial employees. It further provides that collective bargaining by employees in titles (classes of positions) which are not unique to the Judicial Conference, shall be on a city-wide basis only.
None of the titles concerned in these proceedings is unique to the Judicial Conference. Moreover, the records of the City Department of Labor disclose that District Council 37, and/or its affiliated locals, is the the city-wide collective bargaining representative of the employees in these titles. Accordingly, the petitions will be dismissed. O R D E R Pursuant to the power vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby, O R D E R E D, that the petition in each of the proceedings herein be, and the same hereby is, dismissed.
