RU-577-76 - and-THE CITY OF NEW YORK AND RELATED PUBLIC EMPLOYERS --------------------------------X DECISION AND ORDER The petition herein, as amended, seeks to add the title of Scientist (Water Ecology) to Certification No. 46J-75 (as amended), covering various engineering, scientific and related titles. The Citys Office of Labor Relations opposes this petition on the ground that the Petition is premature [because] there are no permanent incumbents ... nor are there any positions budgeted Our investigation shows that the pertinent positions are budgeted and that these employees serve in a program which was Federally funded for nine months beginning April 17, 1976. Moreover, the Environmental Protection Administration expects the funding to be renewed for at least two years. In this regard, it is interesting to note that Scientist (Water Ecology) is a regularly-classified, competitive civil service title.
Decision No. 54-76 2 Docket No. RU-577-76 As Certification No. 46J-75 (as amended by Decisions 47-75, 60-75, 61-75, 5-76, 31-76, 37-76, 41-76, 49-76 and 53-76) covers a unit of engineering, scientific and related titles, we find that the petitioned title should be placed therein. All of the criteria for accretion having been met here, we shall add the petitioned title to Certification No. 46J-75 (as amended). 0 R D E R NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED that Certification No. 46J-75 (as previously amended) be, and the same hereby is, further amended to include the title of Scientist (Water Ecology), subject to existing contracts, if any.
