RU-551-76 Communications Workers of America, AFL-CIO, Intervenor -and-The City of New York and Related Public Employers -------------------------------------X DECISION AND ORDER On March 24, 1976, District Council 37, AFSCME, AFL-CIO (herein called Petitioner) filed its petition herein, seeking to add the titles of Principal Shorthand Reporter and Stenographer (Reporting), Grade 5 (the Latter title is the restored Rule X equivalent of the former) to Certification No. 46C-75 has amended), presently covering various clerical and related titles. On April 22, 1976, Communications Workers of America, AFL-CIO (herein called Intervenor) filed an application to intervene herein, on the ground that the petitioned titles should be added to its Certification No. 41-73 (as amended), covering among others, the titles of Senior Shorthand Reporter and Supervising Shorthand Reporter. The Office of Labor Relations of the City of New York takes no position as to which organization should be certified or which of the two units requested is more appropriate.”
Decision No. 30-76 2 Docket No.-RU-551-76 Appropriate Unit and Representative Status While placement in Petitioners unit.,containing, as it does, several verbatim reporting titles which are somewhat similar to the petitioned titles, would not be inappropriate, we find Intervenors unit more appropriate, since it also contains several verbatim reporting titles, including the two titles immediately below the petitioned titles in the rank order of the Shorthand Reporter Occupational Group. These two titles, Senior and Supervising Shorthand Reporter, are in direct line of promotion to Principal Shorthand Reporter. Intervenors unit also contains all of the certified Rule XI titles to which the incumbents of the petitioned Rule X title of Stenographer (Reporting), Grade 5 were eligible to be reclassified. * A majority of the employees in that unit, as amended herein, have authorized check-off of dues in behalf of Communications Workers of America, AFL-CIO. Accordingly, we shall add the petitioned titles to Intervenors unit. 0 R D E R NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED that the application by Communications Workers of America, AFL-CIO, to intervene herein be, and the same hereby is, granted; and it is further * See Table of Equivalencies in City Civil Service Commission resolution No. 55-118, as amended by CCSC res. no. 56-31. Decision No. 30-76 3 Docket No.-RU-551-76 ORDERED that the petition filed by District Council 37, AFSCME, AFL-CIO, be, and the same hereby is, denied, and it is further ORDERED that Certification No. 41-73 (as previously amended by Decisions 52-73, 68-73, 21-75 and 36-75) be, and the same hereby is further amended to include the titles of Principal Shorthand Reporter and Stenographer (Reporting), Grade 5, subject to existing contracts, if any.
