RU-532-75 -and-CITY OF NEW YORK (Department of Water Resources, Environmental Protection Administration) ------------------------------- x DECISION AND DIRECTION OF ELECTION District No.1-PCD, Marine Engineers Beneficial Association, AFL-CIO, filed a timely petition, accompanied by an appropriate showing of interest, requesting certification as the collective bargaining representative of a unit consisting of Captains (Sludge Boat), Chief Mates, Chief Marine Engineers (Diesel), First Assistant Marine Engineers (Diesel), Able Seamen, and Marine Oilers, serving in the Department of Water Resources of the Environmental Protection Administration. District Council 37, AFSCME, AFL-CIO, intervened in timely manner and also submitted an appropriate showing of interest. Local 333, United Marine Division, which is
Decision No. 56-75 2 Docket No. RU-532-75 certified (7 NYCDL No. 59) for a unit consisting of the cited employees, as well as the vacant title of Second Mate, also intervened in timely manner. We find that the appropriate unit should include not only the employees in the petitioned titles but also the unit title of Second Mate. The Office of Labor Relations of the City of New York "takes no position" in this case. Since the unit found appropriate herein is essentially the same as the petitioned unit, we shall direct an election accordingly. DIRECTION OF ELECTION Pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby DIRECTED that an election by secret ballot shall be conducted under the supervision of the Board or its agents, at a time, place, and during hours to be fixed by the Board, among the employees of the Department of Water Resources, Environmental Protection Administration, in the titles of Captain (Sludge Boat), Chief Mate, Second Mate, Able Seaman, Chief Marine Engineer (Diesel), First Assistant Marine Engineer (Diesel), and Marine Oiler, employed during the payroll period immediately preceding this Direction of Election, other than those employees who have voluntarily quit, retired, or who have been discharged for cause,
