PBA v. City, 16 OCB 41 (BOC 1975)[Decision No. 41-75 (Amend. RU-525-75 -and-THE CITY OF NEW YORK AND RELATED PUBLIC EMPLOYERS --------------------------------- x DECISION AND ORDER AMENDING CERTIFICATION On July 23, 1975, the Detective Investigators Benevolent Association of New York City, Inc., requested an amendment of its Certification No. 30-75 in order to reflect the change of name of that organization to "The Police Benevolent Association of the District Attorney's Offices, City of New York, Inc." This Certification covers employees in the titles of Detective Investigator, Senior Detective Investigator, Rackets Investigator, Senior Rackets Investigator, Supervising Rackets Investigator, County Detective, and Chief County Detective. The affirmation of Donald M. Halperin, Esq., Attorney for the Association, which was submitted in support of the motion, recites that, "... by a vote
Decision No. 41-75 2 Docket No. RU-525-75 of the general membership, D.I.B.A. determined to change its name to THE POLICE BENEVOLENT ASSOCIATION OF THE DISTRICT ATTORNEY'S OFFICES, CITY OF NEW YORK, INC." The affirmation further recites that "... the appropriate papers were filed with the Secretary of State of the State of New York [who] duly authorized such change of name." The affirmation finally states that "The legal requirements for a change of name have been met." Notice of this petition was published in the City Record on August 5, 1975, and posted on the Board's public docket as well as on appropriate employee bulletin boards. No objections have been received as of the date of this decision. Therefore, we shall grant the motion. Such amendment is not, however, to be considered as a new certification or a recertification.
