RU-454-74 -and-THE CITY OF NEW YORK AND RELATED PUBLIC EMPLOYERS - - - - - - - - - - - - - - - - X DECISION AND ORDER On June 27, 1974, District Council 37, AFSCME, AFL-CIO, and its affiliated Local 154, AFSCME, AFL-CIO (herein called Petitioner) filed its petition requesting that the title of Supervising Claim Examiner be added to Certification CWR-62/67 (as amended by Decision No. 25-72), covering Claim Examiners and Senior Claim Examiners. The Office of Labor Relations of the City of New York does not object to this petition. Upon consideration of its investigation and after due deliberation, the Board of Certification issues the following decision: I. Prior Certification The Association of Supervising Claim Examiners was previously recognized as exclusive bargaining representative of Supervising Claim Examiners employed in agencies under the jurisdiction of the Board. 1 The Association was notified of the proceeding herein, but failed to intervene. Accordingly, the Association is deemed to have disclaimed interest in the matter. 2 1 This action had followed certification of the Association by the Transit Authority (an agency not under the jurisdiction of the OCB) as representative of Supervising Claim Examiners in the Authority. 2 See Decisions 6-73 and 29-74.

The Appropriate Unit and Representative Status Supervising Claim Examiners and their restored Rule X equivalents share a community of interest with Claim Examiners and Senior Claim Examiners and should be added to Certification CWR-62/67 (as amended by Decision No-25-72). It also appears to the satisfaction of the Board that a majority of the employees in the unit, as amended herein, have demonstrated their desire to be represented by Petitioner, by having authorized dues check-off in behalf of said organization. 0 R D E R Pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED that Certification CWR-62/67 (as amended by Decision No.25-72) be, and the same hereby is further amended to include Supervising Claim Examiners and employees in restored Rule X titles serving in positions equated thereto, subject to existing contracts, if any.
