RU-420-74 Petitioner -and-COMMUNICATIONS WORKERS OF AMERICA, AFL-CIO, Intervenor -and-THE CITY OF NEW YORK AND RELATED PUBLIC EMPLOYERS, Respondent - - - - - - - - - - - - - - - - - X DECISION AND ORDER AMENDING CERTIFICATION On January 9, 1974, District Council 37, American Federation of State, County, and Municipal Employees, AFL-CIO (hereinafter called petitioner or DC 37) filed its petition herein, seeking to add, by accretion, the titles of Retirement Benefits Examining Trainee, Assistant Retirement Benefits Examiner, Supervising Retirement Benefits Examiner, Principal Retirement Benefits Examiner and Retirement Benefits Counselor to an existing unit of accountant
Decision No. 19-74 Docket No. RU-420-74 2. and actuarial titles for which it was certified by Decision No.69-72. On January 15, 1974, DC 37 amended its petition to include the title of Retirement Benefits Examiner. On February 13, 1974, Communications Workers of America, AFL-CIO (hereinafter called intervenor or CWA) filed its intervention, seeking to have the above-specified titles added to the unit of administrative and clerical titles for which it was certified by Decision No.41-73. By letter dated February 27, 1974, the City of New York Office of Labor Relations informed the Board that it had no objection to the request of DC 37. The matter was noticed for hearing, but prior to the hearing date (on April 8, 1974), CWA requested withdrawal of its intervention before the Board. The Board permits the requested withdrawal. CWA having withdrawn its intervention, and the City of New York having raised no objection to the petition of DC 37, it appears to the satisfaction of the Board that employees in the subsequently-created titles of Retirement Benefits Examining Trainee, Assistant Retirement Benefits Examiner, Retirement Benefits Examiner, Supervising Retirement Benefits Examiner, Principal Retirement Benefits Examiner,
Decision No. 19-74 Docket No. RU-420-74 3. and Retirement Benefits Counselor share a community of interest with employees in the titles-in Certification No.69-72 (as previously amended) and, therefore, should be added to that unit. NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED, that Certification No.69-72 as amended be, and the same hereby is, further amended to include the titles of Retirement Benefits Examining Trainee, Assistant Retirement Benefits Examiner, Retirement Benefits Examiner, Supervising Retirement Benefits Examiner, Principal Retirement Benefits Examiner, and Retirement Benefits Counselor, subject to existing contracts, if any.
