RU-402-73 THE CITY OF NEW YORK AND RELATED PUBLIC EMPLOYERS ---------------------------------X ORDER AMENDING CERTIFICATION The Union having moved, pursuant to Rule 2.19 of the Consolidated Rules of the Office of Collective Bargaining, for amendment of its Certification CWR-44/67, presently covering the titles of Attorney Trainee, Assistant Attorney, Attorney (including specialties), Senior Attorney and Supervising Attorney, by adding thereto the new title of Associate Attorney (including specialty); and No objections to the motion having been filed within the time provided therefor; and Our investigation having confirmed Petitioner's allegation that a title covered in the aforementioned certification has been changed to the title for which this petition is filed; and Our investigation having further revealed that employees in restored Rule X titles serving in positions equated to the certified titles should be included with them in the same bargaining unit; and

RU-402-73 It also appearing to the Board that employees in the sub-sequently-created specialty titles of Assistant Attorney (Taxes) and Senior Attorney (Taxes) share a community of interest with employees in the certified unit and should be included therein; NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED that the titles of Associate Attorney (including specialty) [formerly known as Supervising Attorney (including specialty)], Assistant Attorney (including specialty), Senior Attorney (including specialty), and employees in restored Rule X titles equated thereto be, and the same hereby are, added to Certification CWR-44/67, subject to existing contracts, if any.
