RE-31-73 STATE OF NEW YORK -and-LOCAL 1070, DISTRICT COUNCIL 37, AFSCME, AFL-CIO - - - - - - - - - - - - - - - - - X DECISION AND ORDER REVOKING CERTIFICATION The Office of Labor Relations, by letter dated February 20, 1973, requested this Board to revoke the certification (Decision No. 31-68) covering the titles of Law and Equity Clerk, Head Clerk (Law and Equity), and Chief Clerk (Law and Equity), which is held by Local 1070, D.C. 37, AFSCME, on the ground that said titles "no longer exist." The Office of Labor Relations further stated that these titles "were limited to present incumbents only by the Administrative Board of the Judicial Conference. There are no incumbents ... and there will be no prospective incumbents in these titles."
Decision No.34-73 Docket No. RE-31-73 2. Our investigation confirms this and shows, in addition, that these titles have been vacant for more than three years and that they have been deleted from the classification of the Judicial Conference. The Union, by letter dated March 5, 1973, stated that it does not object to the request of the Office of Labor Relations. 0 R D E R Pursuant to the authority vested in the Board of Certification, it is hereby ordered that Certification No. 31-68, covering the titles of Law and Equity Clerk, Head Clerk (Law and Equity), and Chief Clerk (Law and Equity), be, and the same hereby is, revoked.
