RU-345-72 STATE OF NEW YORK -and-THE CITY OF NEW YORK - - - - - - - - - - - - - - - - - -X DECISION AND ORDER On October 16, 1972, District Council 37, AFSCME, AFL-CIO (herein called Petitioner) filed its petition herein, seeking to add the newly-created title of Principal Key Punch Operator to Certification 9 NYCDL No. 48, held by its affiliated Local 1070, and presently covering the titles of Principal Clerk, Principal Stenographer, Supervising Telephone Operator (City Court), and Foreman of Laborers. Upon consideration of its investigation, and after due deliberation, the Board of Certification issues the following decision: I. Undisputed Matters It is undisputed, and we find and conclude, that Petitioner is a public employee organization in fact and within the meaning of the New York City Collective Bargaining Law.

The Appropriate Unit and Representative Status Certification 9 NYCDL No. 48 was issued in 1967 and covers approximately 66 employees in various supervisory clerical and related titles employed in the Unified Court System within the City of New York. The petitioned title (which has two incumbents) was established in 1972 and performs supervisory "white collar" duties similar to those of the certified titles, although the former specialize in the supervision of key punch or verification machine operation. Employees in the petitioned title have the same salary range as those of most of the employees in titles in the pertinent unit. Both of the Principal Key Punch Operators have authorized check-off of dues in behalf of Petitioner. The employers have interposed no objection to this petition. Accordingly, we shall add the petitioned title to the requested unit. In addition, our investigation shows that the certified title of Supervising Telephone Operator (City Court) has become vacant and obsolete. Accordingly, we shall delete that title from the Certification.
Decision No. 13-73 Docket No. RU-345-72 3. 0 R D E R Pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED that the title of Principal Key Punch operator be, and the same hereby is, added to Certification 9 NYCDL No. 48; and it is further ORDERED that the title of Supervising Telephone Operator (City Court) be, and the same hereby is, deleted from Certification 9 NYCDL No. 48; and, as amended, such unit shall consist of employees in the titles of Principal Key Punch Operator, Principal Clerk, Principal Stenographer, and Foreman of Laborers, employed by the Unified Court System within the City of New York, subject to existing contracts, if any.
