OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION In the Matter of the Certification Proceeding -between- LAW ENFORCEMENT EMPLOYEES BENEVOLENT ASSOCIATION, Petitioner, -and- THE CITY OF NEW YORK, Respondent, -and- COMMUNICATIONS WORKERS OF AMERICA, Intervenor. CERTIFICATION Pursuant to the Interim Decision and Direction of Election in LEEBA, 9 OCB2d 26 (BOC 2016), an election was held by phone and on-line ballot in accordance with the Rules of the Office of Collective Bargaining (Rules of the City of New York, Title 61, Chapter 1) (“OCB Rules”) § 1-02 for employees in the titles of Sanitation Enforcement Agent (Title Code No. 71681) and
10 OCB2d 4 (BOC 2017) 2 Associate Sanitation Enforcement Agent (Title Code No. 71682). The ballots were counted on January 20, 2017. The majority of employees casting valid ballots selected LEEBA as their representative for collective bargaining, and no party filed objections to the election. Accordingly, this Board terminates Certification No. 25-74, held by the Communications Workers of America, and certifies LEEBA as the exclusive bargaining representative of the Sanitation Enforcement Agent bargaining unit in Certification No. 4-17. NOW THEREFORE pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law (New York Administrative Code, Title 12, Chapter 3), it is hereby ORDERED that Certification No. 25-74 be, and the same hereby is, terminated; and it is CERTIFIED that the Law Enforcement Employees Benevolent Association is the exclusive representative for the purposes of collective bargaining for the bargaining unit consisting of the titles Sanitation Enforcement Agent (Title Code No. 71681) and Associate Sanitation Enforcement Agent (Title Code No. 71682).
