RU-302-72 -and-DISTRICT COUNCIL 37, AFSCME, AFL-CIO, Intervenor - and-THE CITY OF NEW YORK AND RELATED PUBLIC EMPLOYERS ----------------------------------X DECISION AND ORDER On February 19, 1972, Local 456, Office and Professional Employees International Union, AFL-CIO (herein called Petitioner) filed its petition requesting certification as the exclusive collective bargaining representative of Community Aides (Model Cities). On March 2, 1972, District Council 37, AFSCME, AFL-CIO (herein called Intervenor), applied to intervene herein. Neither Petitioner nor the City has opposed the application. Accordingly, the application to intervene is granted. Upon consideration of its investigation and after due deliberation, the Board of Certification issues the following decision:
Decision No. 7-72 2 Docket No. RU-302-72 I. The Appropriate Unit The title of Community Aide (Model Cities) is currently certified to Intervenor in Certification No.48-71, as amended by Decision No.66-71. This unit covers approximately 10,000 employees in 42 social service and related titles. There are approximately 250 Community Aides (Model Cities) employed by the City of New York. Thus, Petitioner is seeking certification for some 250 employees now in a bargaining unit of 10,000 employees previously found appropriate by this Board. The requested unit is inconsistent with well established policy against fragmentation of units. Accordingly, we shall dismiss the petition. 0 R D E R Pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED, that the application of District Council 37, AFSCME, AFL-CIO to intervene herein be, and the same hereby is, granted; and it is further
Decision No. 7-72 3 Docket No. RU-302-72 ORDERED, that the petition filed herein by Local 456, office and Professional Employees International Union, AFL-CIO, be, and the same hereby is, dismissed.
