RU-314-72 -and-THE JUDICIAL CONFERENCE OF THE STATE OF NEW YORK -and-THE CITY OF NEW YORK ---------------------------------X DECISION AND ORDER On May 9, 1972, New York State Court Clerks Association (herein called Petitioner) filed its petition herein, seeking to add the newly-created title of Court Clerk I (Records Retrieval System) to its Certification No.29-69 (as previously amended by Decision No.61-69), presently covering Court Clerks I, II, III, and IV, and Surrogates Court Clerks I, II and III (including specialties). Upon consideration of its investigation, and after due deliberation, the Board of Certification issues the following decision: I. Undisputed Matters It is undisputed, and we find and conclude, that Petitioner is a public employee organization in fact and within the meaning of the New York City Collective Bargaining Law.
Decision No. 45-72 2 Docket No. RU-314-72 II. The Appropriate Unit and Representative Status Certification No.29-69 was issued in June, 1969 and later amended in November of the same year. It covered approximately 770 Court Clerks and Surrogates Court Clerks at all levels and in all specialties then in existence. The petitioned title (which has two incumbents) was established in 1971 and has duties and responsibilities similar to those of the certified titles but is specialized in the field of microfilming of court records. It has the same salary range and lines of promotion as those of Court Clerk I without specialty. We find, therefore, that accretion is appropriate. The employers have interposed no objection to this petition. Accordingly, we shall add the petitioned title to the requested unit. 0 R D E R Pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law, it is hereby ORDERED that the title of Court Clerk I (Records Retrieval System) be, and the same hereby is, added to Certification No.29-69 (as previously amended by Decision No.61-69), and, as amended, such unit shall be cited as
Decision No. 45-72 3 Docket No. RU-314-72 Decision No.45-72”, and shall consist of employees in the titles of Court Clerk I (including specialty), Court Clerk II, Court Clerk III, Court Clerk IV, Surrogates Court Clerk I, Surrogates Court Clerk II (including specialties), and Surrogates Court Clerk III (including specialties), employed by the Unified Court System within the City of New York, subject to existing contracts, if any.
