(Official decision follows.) _________________________________________________________________ OFFICE OF COLLECTIVE BARGAINING BOARD OF CERTIFICATION In the Matter of the Certification Proceeding -between-DISTRICT COUNCIL 37, AFSCME, AFL-CIO, Petitioner, -and-CITY OF NEW YORK, Respondent. __________________________________________________________________ ORDER AMENDING CERTIFICATION On November 16, 2007, District Council 37, AFSCME, AFL-CIO (“DC 37”) filed a petition pursuant to § 1-02(u) of the Rules of the Office of Collective Bargaining (Rules of the City of New York, Title 61, Chapter 1) requesting that the title Protection Agent (Temporary Title Code No. 06771) be accreted to Certification No. 37-78, a bargaining unit that includes such titles as Child Protective Specialist and Child Welfare Specialist. Notice of this petition was given to the City of New York and the public, and no timely objections were filed. The Board of Certification is satisfied that no evidence was presented to rebut DC 37’s assertion that Protection Agents have a sufficient community of interest with the members of the certified bargaining unit.
1 OCB2d 1 (BOC 2008) 2 NOW, THEREFORE, pursuant to the powers vested in the Board of Certification by the New York City Collective Bargaining Law (New York City Administrative Code, Title 12, Chapter 3), it is hereby ORDERED that Certification No. 37-78 (as previously amended) be, and the same hereby is, further amended to add the title Protection Agent (Temporary Title Code No. 06771), subject to existing contracts, if any.
