BCB-388-80 (A-623-76) THE UNIFORMED FIRE OFFICERS ASSOCIATION, LOCAL 854, Respondent. ----------------------------------X DECISION AND ORDER On May 21, 1980, the Uniformed Fire Officers Association, Local 854 (hereinafter UFOA”) filed a motion for reconsideration in which it requests this Board to reconsider its Decision No. B-6-80, issued on March 20, 1980, and to substitute in lieu thereof an order denying the Citys petition challenging arbitrability. The City of New York submitted a letter in opposition to the motion on May 29, 1980, and the UFOA filed a response on June 12, 1980. We have reviewed the papers submitted by both parties to this matter. We find that the arguments presented by the UFOA in support of its motion were previously considered by this Board in the course of reaching our decision in B-6-80. Additionally, we agree with the City that Decision Nos. B-3-80 and B-4-80 are in opposite to this matter, and do not support the UFOAs motion.
DECISION NO. B-30-80 2 DOCKET NO. BCB-399-80 (A-623-76) Accordingly, we find no basis to warrant reconsideration of our decision in B-6-80, and we will deny the UFOAs motion. ORDER Pursuant to the powers vested in the Board of Collective Bargaining by the New York City Collective Bargaining Law, it is hereby ORDERED, that the UFOAs motion for reconsideration of Decision No. B-6-80 be, and the same hereby is, denied.
