Summary: Plaintiff and defendant entered into a contract whereby the plaintiff was to run an ad for the defendant for eight weeks. The defendant ran into financial problems and had discussions with the plaintiff regarding the possibility of ending the contract early. The defendant alleges that this conversation should have terminated the contract. The plaintiff, however, alleges that in waiting for the defendant to make its final decision as to whether to end the contract early or not, it continued to fulfill its contractual obligations, rant the ad as per the original contract, and now seeks full payment of the contract from the defendant. The court found no evidence that there was a cancellation of the contract.
