Territorial Court

Decision Information

Decision information:

Summary: During tune-up of plaintiff's truck the threads holding a spark plug in place were damaged. Unable to have the repair work done at this shop the plaintiff took his truck directly to the defendant's shop to have the threads re-cut or replaced. Following the completion of this work the plaintiff noticed his truck was running roughly and learned that a valve in one of the truck's cylinders was slightly bent resulting in decreased performance. The plaintiff seeks damages against the defendant claiming that this damage occurred during the defendant's work on the vehicle. The court, however, could not find evidence that the bent cylinder was a direct result from the type of work the second shop did on the truck. It was possible this damage could have occurred during the tune-up work that was done at the first shop, but this was unclear as the mechanic of the first shop was not called as a witness.
