Summary: 37 year old accused pleads guilty to assaulting his wife by kicking her in the face which causes bruising, swelling and a scratch. Court considered that accused requires treatment for his temper as his criminal record indicates he has 10 previous assault charges. Court stated that ordinarily it would consider imposing a longer period of time in gaol following such a lenghty criminal record. But court also determines that assault was not delivered with a hard shoe, but a runner and that it did not result in major injury.
