Summary: 47 year old accused pled guilty to assaulting a friend by hitting her on the head with a crib board which created a cut. Alcohol was involved. Accused had apologized to complainant, who was her friend, and they have resumed their friendship. Court considered discharge, however, did not find that the penalty imposed would be more severe on the accused than otherwise penalizing other persons. Furthermore, the court found that it was not in the public interest to grant a discharge in this instance as assaults were becoming more frequent.
Decision: Sentence determined - $150 or in default, 2 weeks imprisonment
