Decision Information

Decision information:

Summary: Application for interim relief in divorce action ending 23 year marriage. Alleged that four of seven children of the marriage are still dependent. Parents agree the 16 and 8 year olds still live with mother. However, disagree over where 13 and 4 year olds live. Court finds 13 year old primarily dependent on father even though he visits mother regularly. 4 year old had been adopted but now lives with natural mother who wants adoption reversed. Father argues already custom adopted back. But natural mother and 4 year old spend lots of time at mother applicant's. Court finds applicant has grandmother relationship with 4 year old, but that the child is primarily dependant on its natural mother not grandmother / pettitioner.
Decision: Father to pay maintenance for 2 children, ages 16 and 8
Subjects: Family law - Children - Maintenance
