Summary: Separated after being married only five months. One child born. Divorced in 1979 and father ordered to pay 50.00 per month spousal support and 150.00 per month child support. Father unemployed for many months, suffers from some physical limitations, no reasonable prospect of future employment, now has 22,886.80 support arrears. Applies to have arrears reduced and future support varied. Mother served substitutionaly in Alberta. Child turned 16 years old in September of 1994. No evidence that child is still a "child of the marriage," therefore no obligation to pay child support and arrears adjusted. Court determined time limited spousal support for five years appropriate for this marriage of extremely short duration, which further reduced arrears. Is a possibility of paying balance of 4,107.80 arrears in future. Order only provisional until respondent accepts jurisdiction of this court.
