Supreme Court

Decision Information

Decision information:

Summary: Two daughters born during eleven year marriage. Two children live with Mother. Mother is waitress earning 1386.66 monthly, father contracts with Canada Post at 2932.50 per month. He let second contract lapse because no profit made. Mother claims current monthly expenses are 1595.19, but to support children to standard of living prior to separation would require 2056.19 monthly. Father claims it is unreasonable to raise children's standard of living beyond that of parents. Court determines lifestyle of former family unit is a good first test of support required, but then courts should consider Levesque case law and look at parent's combined gross income against childcare costs. Just because parents spent no money on children's entertainment and recreation when they were young does not mean same will apply in future. Goal for the children should be standard of living commensurate with their parent's income. Child support obligations come before Father's monthly 87.00 cable vision and 200.00 telephone expenses and other debt payments like mortgage.
Decision: $500.00 per month per child interim child support ordered.
Subjects: Family law - Children - Maintenance
