Summary: Application for variation of the Corollary Relief Order of October 23, 1989. Both children residing with mother since 1991. Court found it in the best interest of children for mother to have sole custody. Somewhat more detailed access terms for father set out, but as children get older they may make their own personal wishes known to a greater extent. Difficult financial circumstances encounter by both parties. Father cannot pay guideline amount of child support without jeopardizing his subsistence and possibility of paying any child support.
Decision: Mother granted sole custody. Father ordered to pay $250.00 per child every month (lower than guideline amount) and submit complete current financial statement and income tax return each August for review.
