Summary: Accuseds were convicted of the offence of operating a commercial air service without the necessary authorization, contrary to the Aeronautics Act -- Record of regulatory infractions and non-compliance -- Crown was asking for a strong denunciatory and deterrent penalty including imprisonment. Court held that as the individual accused posed no danger to the community there was no reason to have him actually incarcerated, and that there was evidence of his inability to pay a fine - Evidence established that the legal ownership of the aircrafts rested with others and therefore the Court declined to order their forfeiture.
Decision: Sentence determined - Jensen sentenced to serve a conditional sentence of two years imprisonment, subject to the usual statutory conditions ; Spur Aviation ordered to pay a fine of $50,000, such payment to be made within six months
