Abstract: Claim by Plaintiff for costs following judgment. The Defendant sought to be relieved of costs based on an oral offer, made without reference to Rules and costs at the outset of the proceedings to pay the Plaintiff almost exactly the same amount recovered in the judgment. The offer was not subsequent repeated during the court of the litigation. The key to making an offer that will have a costs effect is to notify the other side of that intention.
Decision: Application denied. Offer did not comply with the Rules and therefore had not costs effect.
