Abstract: Application for variation in the amount of child support payable under a corollary relief order of this Court - Petitioner seeks to increase the amount of support payable to her on behalf of the two children of the marriage - Parties signed a separation agreement which acknowledged that the Respondent was assuming the debts of the marriage and requiring him to pay only $20.00 per month in child support - Petitioner contends there has been a change in circumstances and that support should be varied accordingly.
Decision: Application granted - Court found a significant increase in the Respondent's income since the time of signing the separation agreement - Petitioner successful in proving a change in circumstances and support to be varied to $300.00 per month per child for ten months of the year.
