Abstract: Application by the Respondent to vary an order for child support made in her absence - Respondent contends that the order should be varied to reflect the fact the eldest child is no longer a child of the marriage - Respondent further contends that the expenses claimed by the Petitioner are excessive, that her non-monetary contributions should be taken into account and that the order should reflect her income rather her earning capacity.
Decision: Application granted in part - Petitioner failed to show that the eldest child is in need of on-going support and order should be varied accordingly - Court found some expenses claimed by the Petitioner to be excessive, but would not make a ruling on this point without further evidence - Finally, Court found the non-monetary contributions made by the Respondent to be the normal expenses of an access parent.
