Morrow In Court at the City of Yellowknife in the Northwest Territories on Tuesday the 10th. day of February A.D. 1975, J-U D G E M E N T The Appellant having appealed the sentence of $500.00 fine with 6 weeks to pay and one month in default and the order prohibiting the Appellant from driving a motor vehicle in Canada for the next nine months except half an hour before and after shift, imposed on him by Chief Magistrate F.G. Smith in Yellowknife on the 26th. of January A.D. 1976 on the following charge: "that" he on or about the 10th. day of January A.D. 1976, at or near the city of Yellowknife in the Northwest Territories, having consumed alcohol in such a quantity that the proportion thereof in his blood exceeded eighty milligrams of alcohol in one hundred millilitres of blood, did unlawfully drive a motor vehicle, contrary to Section 256 of the Criminal Code". AND upon hearing counsel for the Respondent and the Appellant appearing in person;

IT IS HEREBY ORDERED AND ADJUDGED AS FOLLOWS: 1. THAT the sentence imposed upon the Appellant by by the said Chief Magistrate be varied in that the Appellant be prohibited from driving a motor vehicle in Canada for the nine months following the 26th. of January A.D. 1976 except from to and at work of any kind, only.
