IN THE SUPREME COURT OF THE NORTHWEST TERRITORIES B E T W E E N : the 3(!n,-, VERNA ELLEN WOZNICA, PETITIONER AND: LAWRENCE MICHAEL WOZNICA, RESPONDENT F I A T This action for divorce and ancillary relief was tried before me at Hay River in the Northwest Territories on November 1st, 1977.

At the conclusion of the evidence adduced for the Petitioner I indicated that I was not satisfied that the case had been proven on the balance of probabilities and under the circumstances I adjourned the matter sine die with leave to adduce further evidence if counsel was so advised.

No such application has been made to me to adduce further evidence and under the circumstances I therefore dismiss ^j the petition for divorce without costs.
