Summary: A union has been exercising its right to picket at a mine site, where vandals have been repeatedly damaging the effluent treatment system. The plaintiff has presented uncontested evidence to the court that the resulting situation at the mine site is such that the health and safety of the general public is at risk, unless repairs are made to the effluent treatment system. The plaintiff makes application to amend the present court order, which allowed the union members to picket in immediate proximity of this health risk site, such that the picketers will now remain well back of this hazardous site.
