Abstract: Hearing pursuant to section 20 of the Territorial Lands Act allowing an opportunity to Respondent to show cause why an order should not be made removing him from unauthorized occupation of Crown lands - Respondent is a business man who has occupied certain Crown lands since 1980 without a lease - Respondent claims, among his arguments, that the use constituted a necessary adjunct to a commercial lease granted to the Respondent at the same time and that such use was intermittent only - Respondent further contends that the Applicant has violated principles of natural justice in bringing this claim and that he was given oral authorization to use the lands in question
Decision: Order of removal granted - Court found no merit to the submissions of the Respondent and further found it unreasonable for the Respondent to have relied on an oral agreement with an individual without authority when he had been denied a land lease by the Applicant in relation to the land in question.
