Abstract: Application by the Applicant for variation of a custody order made in Ontario - Parties divorced in 1984 and Respondent granted custody of two children of the marriage - While visiting Applicant in Yellowknife children complained of physical abuse at the hands of their step-father in Ontario - Applicant commenced present action as a result.
Decision: Application denied - Children most substantially connected to Ontario therefore matter should be heard there - Court found no evidence of abuse but noted that the authorities in Ontario had been alerted to the allegations and would monitor the children.
