Abstract: Application to determine custody of a nine year old child - Applicant had de facto custody of the child in the United States where the child has resided all her life - Respondent absconded surreptitiously to this jurisdiction with the child contrary to an order of the Superior Court of New Jersey - Outstanding action in Superior Court relating to the custody of the child.
Decision: Court declined to assume jurisdiction due to the Court in New Jersey being seized of the matter - Court did order that the child be returned to the custody of the Applicant to be returned to New Jersey where the matter will be resolved.
