Abstract: Application for an order in the nature of certiorari to set aside a decision of the Labour Standards Board confirming a Labour Standards Officer's certificate as to wages owing - Applicant appeals on the grounds that the Board exceeded its jurisdiction by failing to address Applicant=s written evidence with respect to overtime, and that the Board failed to hold proceedings in accordance with the principles of natural justice.
Decision: Application dismissed - Court found the Board did not fail to address written evidence on over-time, but in the event that it did, it had other evidence upon which it could proceed - Court found the Board did not fail to conduct proceedings in accordance with the principles of natural justice - Applicant indicated a willingness to adduce oral evidence if this would be helpful for the Board - Applicant did not contend that oral evidence was necessary in order to present a full case - Board did not err by not requiring oral evidence to be heard - Finally, Board did not err by not providing adequate or intelligible reasons for its decision - The Act does not require that reasons be provided.
