Decision: Petition granted - Court found both parties were cruel to each other under the definition in the Divorce Act - Court awarded matrimonial home to the Applicant - Applicant and child residing in home presently - Applicant made substantial renovations herself and secured a loan to redeem the mortgage after the Respondent ceased to make payments and foreclosure was imminent.
