Abstract: Petition for divorce on the basis of adultery - Counterpetition on the basis of cruelty - Respondent seeks access to the Petitioner=s daughter - Petitioner claims one half interest in the insurance proceeds received from the destruction by fire of the matrimonial home - Respondent makes no claim against the Petitioner.
Decision: Divorce granted on the basis of adultery - Court found insufficient evidence of cruelty upon which to grant a divorce - No order for access by the Respondent to the daughter of the Petitioner as she is not a child of the marriage under the Divorce Act - History of violence and alcohol abuse by the parties would make access inappropriate in any event - Parties both self-sufficient and no order made for support - Petitioner to keep her interest in two small businesses owned by her - Respondent to keep insurance proceeds of matrimonial home.
