Abstract: Appeal by town against a decision of the Public Utilities Board - Board erring in law in its decision to amend a franchise renewal to town, substituting its own scale for the calculation of a certain charge to be made by the Company against its customers in place of scale agreed on by town and company in previous agreement - No express powers given to Court to set aside or vary decision or order of Board under Public Utilities Ordinance - Court finding nothing in Ordinance which empowers Board to nitself amend or rectify a franchise or an alteration or renewal of a franchise.
Decision: Appeal allowed - Costs reserved.
