Abstract: Application for writ of possession of premises on the basis that the lease had expired. The Landlord sent the tenant a letter terminating the tenancy. The tenant did not respond or provide an indication of compliance and the Landlord retained counsel who issued a second notice. The effect of the second notice was to override the first notice.
Decision: Application dismissed. The Landlord waiver the letter notice and by doing so extended the lease for one more month.
