Decision information:

Abstract: Appeal of a preliminary ruling of the Board on the extent of a director's right to challenge the company's liability when a certificate is issued pursuant to s. 62 of the Act. The company had previously argued the issue of its liability. To permit the director to now do it again would be a relitigation of the issues. The doctrine of issue estoppel arises to prevent relitigation of the issue of the company's liability to the respondents for unpaid wages.
Decision: Appeal dismissed.
